Application
- These general rental conditions apply to reservations and agreements regarding the holiday home "Casa Zinzi" standing and located at Calle de Perez Galdos 51, 30740 in San Pedro del Pinatar (Spain).
- In these general rental conditions, the term "tenant" is understood to mean: the person who enters into a rental agreement with us with regard to the rental of the holiday home.
- These general terms and conditions apply regardless of your (previous) reference to any own terms and conditions or to other general terms and conditions. We disclaim any terms and conditions to which you refer or which are used by you.
- Agreements deviating from these general terms and conditions are only valid if agreed in writing.
Article 1 - Reservations
- We only accept reservations from persons who are 18 years of age or older. Reservations by persons under that age are therefore not valid. We reserve the right to refuse a reservation at any time – without giving reasons.
- After you have made your reservation, you will receive a confirmation from us within 48 hours. Payment of the booking fee is subject to the conditions described in Article 2.
- We ask you to check these documents for accuracy and to inform us immediately of any inaccuracies. If you have not received a confirmation of receipt from us within 10 days of making the reservation, please contact us immediately. Failure to report this can no longer be invoked on the reservation, it has expired.
- An agreement is concluded between you and us at the moment we have confirmed the reservation to you. The agreement concerns the rental of the holiday home for recreational use, which by its nature is of short duration pursuant to Article 7:232 paragraph 2 of the Dutch Civil Code.
Article 2 - Payment
- The following conditions apply to payment:
- Payments must be made through the cashless route;
- You must pay 30% of the rental amount as well as the entire deposit within 7 days after booking. The remaining amount of 70% of the rent must be paid 6 weeks before the arrival date.
- If your reservation is within one month before the arrival date, you must transfer 100% of the booking amount as well as the deposit to us at once after making the booking.
- Payments must be made by bank transfer to IBAN: ES08 0073 0100 5607 8313 5537 in the name of S. Hol in Gorinchem, stating the booking number. By paying a (partial) payment of or the entire rent, you confirm that you have read and agree to the general rental conditions. The lease ends by operation of law after the expiry of the agreed period. In the event of late payment, as described under a of this article, you will be in default immediately after the payment term has expired. In that case, we reserve the right to cancel your reservation and dissolve the agreement.
Deposit
- A deposit of € 300.00 will be charged to the tenant, which serves to guarantee damage and/or costs in the broadest sense of the word that we can withhold in the event of non-compliance with the obligations of the tenant as a good tenant and those accompanying the tenant.
- The deposit must, as already described in Article 2 under II and III, be paid together with the (first) payment of the booking amount.
- In the event that the deposit is not paid, we are entitled to deny the tenant access to the holiday home. If you fail to pay the deposit, we are also entitled to terminate the agreement with immediate effect.
- The deposit or any remainder thereof will be refunded to an account to be specified by the tenant within 14 days after settlement of any claims (e.g. damage to inventory/holiday home and/or other costs) and after it has been passed on to the landlord. Any (further) claim for compensation will not be nullified by us by this refund.
- If in the event of (possible) damage it turns out that the deposit is not sufficient to compensate the full damage, we reserve the right to hold you liable for the (remaining) damage.
Article 4 - Amendments
- If the tenant, after the conclusion of the booking/agreement, wishes to make changes to the booking, we are not obliged to comply with this. It is at our discretion whether and to what extent changes are accepted. In principle, changes within 4 weeks before arrival cannot be allowed.
- If the tenant changes to another or non-subsequent/consecutive period of stay after the booking has been made, the cancellation provisions as stated in Article 5 apply. In any case, a period of stay is understood to mean a period that does not fall within the period of stay reserved by the tenant (and confirmed by the landlord).
Article 5 - Cancellation
Cancellation by the tenant must always be made in writing (by post or by e-mail). The following conditions apply:
- Renter can cancel free of charge up to 42 before arrival. In that case, the monies already paid will be refunded.
- In case of cancellation from 42 days to the day of arrival, 100% of the rent is due.
- If you have not arrived within 24 hours of the agreed date without further notice, this will be considered a cancellation and 100% of the rental price will be due
- In case of cancellation on our part, any money already paid will be refunded.
Article 6 – Receipt of key
- The key will be handed over on site by our property manager Costa Calida 4 You. They will contact you regarding your itinerary or your arrival time. Information about this can be found in the information letter you will receive. The tenant is not entitled to duplicate the key for any reason. If the tenant does so, the tenant will owe a fine of € 500, regardless of the actual costs. The key to the holiday home is made available to the tenant on loan. The key remains our property. In the event of loss, theft or any other way of losing the key, the tenant owes an amount of € 100.
- All costs incurred because you do not deliver the house on time will be recovered from you. Goods found after your departure will be kept for you for a reasonable period of time, but we will not take any responsibility for this. Subsequent shipping is only possible at your expense.
- If the tenant and/or other users have locked themselves out of the holiday home: Casa Zinzi, € 25 will be charged. This will be deducted from the refund of the deposit. For verification, we ask the tenant to identify himself before handing over the copy of the key.
Article 7 - Accommodation in the holiday home
The following periods and times of stay apply to reservations/stays, namely:
- The tenant and other users must behave as a good tenant during the stay in and around the house. The rules of the apartment complex (including swimming pool area) are observed.
- On the day of arrival you can use the house from 15:00. On the day of departure, you must have left the house by 11:00 am. Different times are only possible in consultation with the key manager Costa Calida 4 You.
- The holiday home is completely non-smoking. This also applies to the use of E-cigarettes. Smoking is allowed outside on the terrace. op het terras mag wel gerookt worden.
- No open flames may be used outside.
- Pets are not allowed. niet toegestaan.
- Parties and celebrations are not allowed. niet toegestaan.
- The rent does not include mandatory final cleaning. € 175 per rental period will be charged for this.
- Barbecuing with the barbecue is allowed (it must be left clean before leaving the house). The use of water and electricity is included, but we kindly ask you to use them sparingly.
- Accommodation of more people in the holiday home than agreed (at the time of booking), or than the maximum of six people applicable to the house is expressly not permitted without our permission, unless otherwise agreed in writing. Parties are also prohibited. This may lead to the premature termination of the lease on our part, without restitution of the rent.
- Moving cupboards as well as sound or television equipment or taking any part of the (indoor) inventory outside is expressly not allowed, with the exception of the crockery/glasses and cutlery for your meal outside.
Article 8 - Force majeur
- Force majeure on our part exists if the execution of the agreement is prevented in whole or in part, temporarily or otherwise, by circumstances beyond our control, including the threat of war, staff strikes, blockades, fire, floods and other disruptions or events.
Article 9 - Liability/complaints/damage
- During the rental period in question, the tenant and other users are fully and jointly liable for all damage that has occurred to the house, the inventory and all items belonging to the rented object, unless the tenant and other users can make a plausible case that the damage cannot be attributed to them. We therefore recommend that you inspect the inventory for defects upon arrival at the holiday home and, if you notice any damage or defects, please report this to us immediately.
- We accept no liability for theft, loss or damage to goods or persons, of any kind, during or as a result of the stay in the holiday home.
- We accept no liability for construction activities on the (main) roads, etc. in the vicinity of. We accept no liability in the event of failure or deactivation of technical equipment, utilities, the non-functioning or partial non-functioning of the internet and/or TV.
- The costs of normal maintenance and repair of defects are at our expense. If defects occur, the tenant must inform us immediately and follow our instructions as much as possible.
- If you still want to submit a complaint, it must be submitted to us in writing and motivated within 14 days after leaving the holiday home.
Article 10 - Departure and final cleaning
In the event of incorrect use or improper abandonment of the holiday home, additional (cleaning) costs may be charged to the tenant. After the end of the period of stay, the tenant must:
- Leaving the house (broom) clean and tidy
- Everything washed clean, dried and put back in the closet;
- Bed linen and towels to be left in the laundry baskets;
- Leaving the dishwasher and refrigerators clean and empty;
- Take food with you and not leave it in the cupboard(s) and/or fridge(s)/freezer;
- Emptied garbage cans;
- Any breakage and/or damage to be reported to the manager (Costa Calida 4 You) or to us.
Article 11 - Applicable law
All our terms and conditions from the rental agreement/house rules as well as any disputes arising from them are exclusively governed by Dutch law.
